Job description: Creating backyard underground system to prevent flooding of driveway & backyard

Comment: 12/14/19 I signed a contract for excavation work to install a dry well for storm drainage as my backyard & driveway were flooding. Contractor said gave a lot of thought as to how to correct the problem and assured me the results of his plan would be guaranteed for 25 years.

He refused to get a city permit as he said it "was not necessary". He refused to call Miss Dig as "there are no utilities that are ever under backyards". He scoffed at neighbor's comment that the plan would prove to be ineffective as our soil is mainly clay. He began/completed work on 12/20. On 12/30/19, driveway/backyard flooded. I contacted him. He said "yeah well you didn't have the soil removed properly so all the water from the backyard diverted to the driveway. I'm on vacation".On 1/1/20 he sent an email stating, "i will add more piping and stone to increase the size of the dry well at no additional cost." On 1/7/20, I received a voicemail stating nothing more than, "we will be there in the morning". When I left for work on 1/8/20 at 9:30 am, he was not present. When I returned at 3:30 pm, there were large machines in the backyard and a crew present. They left at 4 pm with no communication re: what had transpired. On 1/11/20, there was significant flooding to driveway and backyard. I contacted him several times during the day to no avail. Late afternoon he finally replied to state "...these are not normal conditions so you're gonna have to stop being unrealistic and just deal with it..". Also he stated, "further excavation will come at additional cost. The contract specifically states the installation of a dry well was completed, is intact and will be for 25 years."

Obviously, the only reason I had the dry well installed was upon his "professional" recommendation that this would correct the flooding situation. It has rained twice since installation took place and I've had massive flooding both times. He has no intention of correcting this problem so literally my $5200 went down the drain. As a senior citizen that saved for years to have this done, I can't begin to tell you how disheartened I am but there's nothing I can do about it. Thank you so much for providing me an outlet for my feelings. Hopefully, this won't happen to other people...
